If a prospective client decides not to engage SOAP AD and subsequently appoints another agency, consultant, freelancer or service provider, none of the concepts, ideas, strategic recommendations, creative directions, visual materials, campaign proposals, brand positioning exercises, naming proposals, slogans, mood boards or other intellectual creations developed by SOAP AD may be used, directly or indirectly, by the client or any third party.
Any unauthorized use of such materials shall constitute an infringement of SOAP AD's intellectual property rights and may give rise to legal action and claims for damages.
